Terms and Conditions

1. Scope

These Terms and Conditions govern the use of the «AuctionPlace» platform, operated by Wohnliegenschaften Management AG, Bahnhofstrasse 6, 8952 Schlieren, Switzerland. By using the website or purchasing a membership, you accept these terms.

2. Services

AuctionPlace curates information on real estate auctions and related publications. The platform provides search, display, notification and membership features. The specific scope of services may vary depending on the property, publication status, source and membership.

AuctionPlace is purely an information and content-preparation platform. We are neither the organiser nor the conductor of the auctions displayed and are not a party to the underlying proceedings. Forced auctions and comparable official realisations are carried out exclusively by the competent authorities (in particular debt-enforcement and bankruptcy offices, courts or third parties mandated by them). Only the competent authority or the relevant official publication can provide binding or substantive information about a specific auction — e.g. regarding the terms of sale, deposit, payment modalities and deadlines, liens and arrears, valuations, the coverage principle or authorisation requirements (e.g. Lex Koller). We provide no legal advice and no binding information on a specific auction; the competent official authority and the original publications always prevail.

Enquiries submitted via the platform (including document requests) by users without a paid membership are handled on a voluntary, best-effort basis without any entitlement to a substantive response. For Concierge members, we answer questions on individual auction listings within the scope of the booked services; such answers are advisory in nature, are given to the best of our knowledge and replace neither official information nor legal, tax or financial advice.

3. Memberships and access

Certain content and features are available only to registered or paying members. Memberships are personal and may not be transferred to third parties or shared abusively without our consent.

4. Prices and billing

Prices, billing periods and service descriptions are shown on the respective offer pages. All prices are final prices in Swiss francs (CHF) including any applicable statutory VAT. A contract for a paid membership is only concluded once the designated checkout or an otherwise agreed contract confirmation has been successfully completed.

5. Term, renewal and cancellation

Paid memberships run for one month or one year depending on the chosen billing period and renew automatically for the same period unless cancelled beforehand. You may cancel your membership at any time with effect from the end of the current billing period — directly via the customer portal in your account (“billing portal”) or by email to contact@wohnliegenschaften-management.ch. Access remains active until the end of the paid period; amounts already paid for the current period are not refunded pro rata to the extent permitted by law. Price changes are announced at least 30 days in advance; they only apply from the next renewal, and you may cancel at any time until then.

6. Right of withdrawal for consumers (EU/EEA)

Consumers habitually resident in the EU/EEA have a statutory right of withdrawal of 14 days from conclusion of a distance contract. As our memberships include immediate access to digital content and services, the following applies: by completing the checkout you expressly request that we provide the service immediately — before the withdrawal period expires. If you subsequently withdraw within the period, you owe us a proportionate amount for the service provided up to the withdrawal; once the service has been fully performed within the period, the right of withdrawal expires. Withdrawal requires no specific form, e.g. by email to contact@wohnliegenschaften-management.ch. Customers domiciled in Switzerland have no statutory right of withdrawal for online purchases; the cancellation rule in section 5 applies.

7. Payment processing

Payments are processed by the payment service provider Stripe. You enter your payment details directly with Stripe; Stripe's terms and privacy policy apply in addition. In the event of failed payments, we may suspend access to paid features until payment has been made.

8. Availability and content

We strive for high availability and careful preparation of content. Nevertheless, listings, documents, images, location information or additional details may be incomplete, change or be removed at short notice. The official publications and original documents remain authoritative.

9. Permitted use

The platform may only be used within the scope of applicable law and these terms. In particular, automated scraping, circumvention of technical access rules, abusive sharing of member access and any use that impairs the platform or third parties are prohibited.

10. Liability

We are not liable for the accuracy, completeness or timeliness of external or official sources and do not warrant that a property is available on the terms presented on the platform. To the extent permitted by law, our liability is limited to damage caused intentionally or by gross negligence.

11. Intellectual property

The content, structure, design and editorial preparation of the platform are protected by copyright and/or trademark law. Use is permitted only within the scope of intended use.

12. Data protection

The processing of personal data is governed by our privacy policy, which forms a supplementary part of these terms.

13. Changes to these terms

We may amend these terms at any time if our services, processes or legal requirements change. The version published on this website is authoritative; changes take effect upon publication. If you continue to use the platform after a change, the amended terms are deemed accepted. Paying members may cancel their membership at any time, with effect from the end of the current billing period.

14. Severability

Should individual provisions of these terms be invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid rule that comes closest to its economic purpose.

15. Governing law and jurisdiction

Swiss substantive law applies. The place of jurisdiction is, to the extent permitted by law, Schlieren, Switzerland.
